Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Who This Notice Applies To

IV Glow Bar & Co LLC ("the Medical Group," "we," "us") operates as a medical practice in California and provides clinical services, including telehealth consultations, prescriptions, and in-clinic procedures, through licensed providers. The Medical Group is a covered entity under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and is required to maintain the privacy of your Protected Health Information ("PHI"), provide you with this Notice, and follow the terms of this Notice currently in effect.

This Notice does not apply to IV Glow Bar Inc, the platform operator that runs the ivglowbar.com website and handles non-medical customer service. Information you provide to IV Glow Bar Inc that is not part of your clinical care is governed by the separate Privacy Policy.

2. How We May Use and Disclose Your PHI Without Authorization

For Treatment

We use and disclose your PHI to provide, coordinate, and manage your health care. This includes sharing PHI with physicians, nurses, pharmacies, laboratories, and other providers involved in your care. For example, we will provide your prescription information to the compounding pharmacy filling your prescription.

For Payment

We use and disclose your PHI to bill and receive payment for services. This may include disclosing PHI to billing companies, payment processors, and (where applicable) insurance carriers, all subject to appropriate safeguards.

For Health Care Operations

We use and disclose your PHI to operate the Medical Group, including quality assessment, clinician evaluation, credentialing, compliance review, training, legal services, and general business management.

Required By Law

We will disclose PHI when required by federal, state, or local law, including in response to a subpoena, court order, or other legal process.

Public Health and Safety

We may disclose PHI for public-health activities (e.g., disease reporting, FDA adverse-event reporting), to report suspected abuse or neglect, to a health oversight agency, or to avert a serious threat to health or safety.

Business Associates

We engage third parties ("business associates") to perform certain functions on our behalf, including practice-management software, telehealth platforms, billing services, and IT services. We require each business associate to safeguard PHI under a written Business Associate Agreement before we share any PHI.

3. Uses and Disclosures That Require Your Written Authorization

We will obtain your written authorization before we use or disclose your PHI for any purpose not listed above. Specifically, authorization is required for: (a) most uses and disclosures of psychotherapy notes; (b) any use or disclosure for marketing purposes (other than face-to-face communications or promotional gifts of nominal value); (c) any disclosure that constitutes a sale of PHI under HIPAA. You may revoke your authorization in writing at any time. Revocation does not affect uses or disclosures that have already occurred.

4. Your Rights Regarding Your PHI

  • Right to inspect and copy your PHI. You may request access to your medical records. We will respond within 30 days. We may charge a reasonable, cost-based fee for copies.
  • Right to request amendment. If you believe PHI we maintain is incorrect or incomplete, you may request that we amend it. We may deny the request in certain circumstances permitted by law.
  • Right to an accounting of disclosures. You may request a list of disclosures we have made of your PHI (other than disclosures for treatment, payment, or health care operations) in the prior six years.
  • Right to request restrictions. You may request that we limit how we use or disclose your PHI. We are not required to agree to all requests, but we will consider each in good faith. We will honor your request to restrict disclosures to a health plan if the disclosure relates to a service you have paid for in full out of pocket.
  • Right to request confidential communications. You may request that we communicate with you about medical matters in a specific way or at a specific location (for example, only by email, or only at a specific phone number).
  • Right to receive notification of a breach. We will notify you in the event of a breach of unsecured PHI as required by law.
  • Right to a paper copy of this Notice. You may request a paper copy at any time, even if you have agreed to receive this Notice electronically.

5. Telehealth-Specific Notes

When you participate in a telehealth visit, the audio and video are transmitted using a HIPAA-compliant platform (Mindbody) and are not recorded except with your specific written consent. Your provider may take notes during the visit; those notes become part of your medical record.

Email and SMS messages sent to or from us may not be fully secure. You may request that we use a secure messaging method, or that we limit certain communications to your account portal.

Marketing analytics and advertising pixels deployed on the ivglowbar.com website are configured to exclude PHI. We do not sell PHI for advertising purposes, and we do not share PHI with advertising platforms.

6. Changes to This Notice

We may change this Notice from time to time. Any change will apply to PHI we already have about you as well as PHI we may receive in the future. The new Notice will be posted on our website and a copy will be available on request. The effective date of the Notice currently in effect is noted at the top.

7. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us, or with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
